King.com Accused of More Trademark Bullying

In a matter of weeks after King.com said that they would be "respectful of the rights and IP of other developers," and before launching any game, they would thoroughly "search of other games in the marketplace, as well as a review of trademark filings, to ensure that we are not infringing anyone else's IP," it's coming out that that's not necessarily true.

Meet the developer of CandySwipe, Albert Ransom, President and Founder of Runsome Apps, Inc. He created CandySwipe back in 2010 that is a match-3 game featuring candy. It also looks remarkably like Candy Crush Saga in many, many ways.

Ransom knew this when Candy Crush Saga entered the market, and he even filed a Notice of Opposition against King.com for "likelihood of confusion," similarly to King.com's opposition to The Banner Saga trademark filing. Now King.com is working toward canceling Random's CandySwipe trademark that he filed in 2010.

Ransom detailed the entire ordeal in an open letter to King.com.

King.com's filing against CandySwipe says the following:

Runsome has argued that Candy Crush Saga is confusingly similar to CandySwipe. If true, CandySwipe is confusingly similar to Candy Crusher such that consumers will likely wrongly associate Runsome's CandySwipe game with King's prior Candy Crusher mark. This would damage King and supports King's proposed petition for cancellation of Runsome's registration...

"I have spent over three years working on this game as an independent app developer," Ransom said in his open letter. "I learned how to code on my own after my mother passed and CandySwipe was my first and most successful game; it's my livelihood, and you are now attempting to take that away from me. You have taken away the possibility of CandySwipe blossoming into what it has the potential of becoming. I have been quiet, not to exploit the situation, hoping that both sides could agree on a peaceful resolution. However, your move to buy a trademark for the sole purpose of getting away with infringing on the CandySwipe trademark and goodwill just sickens me."

The whole thing makes me sick too, Mr. Ransom.

Get a good lawyer and sue them into the ground. King.com are in the business of ripping people off.
