Terms of Service agreements (TOS) should be fair and equitable to both parties, but sadly this isn't often the case. Since users don't often get to even see the TOS before throwing their money down, this is an especially insidious practice. Nobody has purchased the 3DS, and Zelda games have frequently seemed to have had too many copies at launch. Nintendo may be attempting to play the market and release a limited number of copies of Zelda: Ocarina of Time 3DS when that title hits the market this summer...

The 3DS isn't selling as well as expected. The first week sales were great, and then the second week sales fell off. Nintendo's market research shows that this isn't because people don't want the 3DS, they do, but there is an overwhelming feeling that now is not the time to purchase and adopt the device...

Nintendo had a few things happen today. The company announced that it would likely be releasing a console in 2012 to its investors. There will be a playable demo at E3. 3D has more or less been ruled out of the question. That's about that really. I hope they're selling a console where the controller is a Pip-Boy from Fallout...

Nintendo announced new features for the upcoming Zelda: Ocarina of Time for the 3DS. Not only is one of the greatest games in memory being released in 3D you can stick in your pocket, now it includes the Master Quest (the game with changes and a higher difficulty)...

Most consoles have some major problem to start. The 3DS is no stranger to this, with many complaints. Still, the system is selling like a bag full of stems and seeds to eighth graders (seriously, if you're in high school, you can have the money and the drugs with this scam)...

Capcom releases a trailer
for the spin-off of Resident Evil's Mercenaries mode for Nintendo 3DS, with
the franchise's two key characters (Jill Valentine and Wesker) kicking zombie
butt:

While actual numbers are nowhere to be found, Nintendo is claiming that the 3DS had the best one day sales of any handheld device Nintendo has ever released. There don't appear to be any shortages either. At $250, this is impressive, but the DS already has the largest installed user base of any current generation console, handheld or otherwise, so this isn't exactly shocking...

David Carey, VP of technical intelligence for UBM TechInsights said to EuroGamer that the cost for materials alone for Nintendo to make the 3DS is only one hundred and one dollars. This does not include labor, research and development, marketing or other costs. The 3DS will cost $250 for the American consumer, and something similar everywhere else.
Yeah, sounds about right.

Nintendo is no stranger to the world of litigation, like every other business in the civilized world, and has put warnings about possible damage to the eyes of children by playing the 3DS on the product and in the media. Specifically children under the age of 6 or less, which is likely some critical period for the development of the eye or the perception of images...

The folks over at Ars Technica have gotten to spend some time with the 3DS, and have announced that the system's battery life is 3-5 hours under the best possible conditions. No 3D, no sound, no wireless, and the battery still dies before you know it (this is playing 3DS games mind, and there is an assumed, but as of yet untested hypothesis that original DS games would consume less power)...

The 3DS has been reported to only have a 3-5 hour battery life when playing games. That isn't much, especially compared to a DS which can provide two hours of game time every day for a week before needing to be recharged and without being turned off. There will be a peripheral that will provide extra battery life released on the same day as the 3DS...

Hideki Konno, group manager for the 3DS, recently had a neat interview with Famitsu magazine where he revealed the following:
The 3DS wasn't even in 3D to begin with (which makes you wonder what the hell was going on with it).
The gyroscopic and motion controls were added on last minute after the final system specs had been decided on...
